Terms of Service

01Agreement to these terms

These Terms of Service govern your access to and use of Choir (the “service”), available at choirbroadcast.com. Choir is operated by Golden Goose Projects Pty Ltd (ABN 19 655 429 646) (referred to here as “Choir”, “we”, “us” or “our”). By creating an account or using the service, you agree to these terms. If you're using Choir on behalf of a business, you confirm you have authority to bind that business to these terms. If you don't agree, please don't use the service.

02About Choir

Choir is an AI marketing platform that helps you generate, review and manage marketing content, campaigns, landing pages, and client and lead records across one or more brands. Nothing Choir generates is published or sent without a human approving it first.

03Your account

You must be at least 16 and able to form a binding contract to use Choir. Keep your sign-in secure — you are responsible for activity that happens under your account. Please tell us straight away if you suspect any unauthorised use.

04Plans, credits and billing

• Choir is offered on subscription plans priced in Australian dollars and inclusive of GST. Current plans and prices are shown on our site and may change from time to time.
• Each plan includes a monthly allowance of credits, which are used by generation activities such as posts, video, campaigns and outreach. The credit cost of each activity is shown in the app.
• Included credits refresh at the start of each billing cycle and do not roll over unless we say otherwise. You can also buy one-time top-up credit packs; top-up credits are used after your included credits.
• Subscriptions renew automatically each billing cycle until you cancel. You can cancel at any time; cancellation takes effect at the end of your current paid period, and you keep access until then.
• Payments are processed by Stripe. By subscribing, you authorise us (through Stripe) to charge your payment method for recurring plan fees and any top-ups you buy, and you agree to Stripe’s terms.
• Except where required by law (including the Australian Consumer Law), fees are non-refundable and unused credits have no cash value.

05Free trial

Where we offer a free trial, it gives you limited access for the stated period without payment. Unless you choose a plan and pay, your access ends when the trial ends. We may change or withdraw trials at any time.

06Your content

You keep ownership of the material you submit to Choir and of the outputs it generates for you. You grant us a licence to host, process and transmit that material as needed to operate the service and produce your requested outputs.

You are responsible for your content and for making sure you have the rights to use it — including any client data, brand names, logos, images and contact lists you import.

07AI-generated output

Choir uses AI. Outputs may contain errors, may resemble other material, and are not legal, financial, medical or professional advice.

You must review and approve every output before you publish or send it. You are responsible for its accuracy, legality and compliance — including advertising, spam, privacy and consumer laws — and for obtaining any consents you need before contacting leads or clients.

08Acceptable use

You must not use Choir to:

• Break any law or regulation.
• Send unlawful spam or messages without the consent required by law, including under the Spam Act 2003 (Cth) and Do Not Call Register rules.
• Infringe anyone’s intellectual property, privacy or other rights.
• Upload malicious code, or interfere with, overload or misuse the service.
• Generate deceptive, harmful, discriminatory or otherwise unlawful content.

We may suspend or terminate accounts that breach this section.

09Third-party services

Choir integrates with third-party services such as Stripe, email and SMS delivery providers, and social and publishing platforms. Your use of those services is governed by their own terms, and we are not responsible for them.

10Our intellectual property

Choir, including its software, branding and site, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service in line with these terms. You don't acquire any other rights in the service.

11Availability

We aim to provide a reliable service, but we don't guarantee it will be uninterrupted or error-free. We may carry out maintenance, and we may change or discontinue features from time to time.

12Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term, that the law says we cannot exclude.

Where we are permitted to limit our liability, our liability for a failure to comply with a consumer guarantee is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.

13Limitation of liability

Subject to the Australian Consumer Law and to the extent permitted by law, Choir is not liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill. To the extent permitted by law, our total liability arising from or connected to the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

14Indemnity

To the extent permitted by law, you indemnify us against claims, losses and costs arising from your content, your use of the service, or your breach of these terms or the law.

15Suspension and termination

You can stop using Choir and cancel your subscription at any time. We may suspend or terminate your access if you breach these terms or where we are required to by law. When your access ends, your right to use the service stops, and we may delete your data after a reasonable period, subject to any legal retention obligations.

16Changes to these terms

We may update these terms and our pricing from time to time. If we make material changes, we'll let you know in the app or by email. If you keep using the service after changes take effect, you accept the updated terms.

17Governing law

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
